Obtaining Legally Protected Information in Discovery

This presentation will explore how to navigate the procedural hurdles to acquiring various types of records that an attorney might want to obtain as part of a lawsuit but which are subject to various state and federal privacy laws, such as medical and mental health treatment records. We will discuss requirements for patient consent, and what to do in situations where consent is not readily obtainable. We will also discuss the ongoing privacy obligations imposed on the recipient of confidential records under applicable law.

Whitney Leifheit is an attorney with the Law Firm of Allison & Mosby-Scott in Bloomington, Illinois where she covers several practice areas including civil litigation, real estate, estate planning and administration, immigration, and business law. As a litigator, Attorney Leifheit has experience reviewing and issuing various types of discovery in different contexts, including business and contract disputes, family cases, guardianships and contested estates, and tort claims. She is a graduate of Loyola University Chicago School of Law.
